    The Manager, Trustee Services – Litigation Services is responsible for planning and managing trustee services provided through Staff Trustee and Unclaimed Trust Funds functions in accordance with legislated requirements and Law Society policy.  This includes supervision of the orderly wind up of law practices, the provision of Information Services to assist those helping to facilitate a practice wind-up and formal, court-ordered intervention in practices where a Licensee dies, disappears, is facing discipline or has been suspended, revoked, etc. and where inadequate or no provisions have been made to protect client interests.  The incumbent will also be responsible for supervision of the disposition of applications related to unclaimed trust funds in accordance with Law Society objectives and Convocation requirements.   




    • An LLB, coupled with being a Licensee in good standing of the Law Society*.
    • A minimum of 10 years’ experience, 5 of which working within a regulatory body, or alternatively, in a legal or accounting environment plus a minimum of 2 years in a leadership role leading both professional and support staff.
    • Knowledge of the Law Society Act and Bylaws in general and Trust accounting and the Unclaimed Trust Fund program in particular. 
    • Knowledge of legal practice related to various areas of law.
    • Familiarity with current trends and developments in accounting practices, their practical applications and forensic investigation techniques. 
    • Computer literacy, including word processing software, advanced spreadsheet functions and accounting system software. 
    • Broad understanding of the application to technology preferably in a regulatory / legal environment.

    Client / Customer Service Planning


    • In consultation with the Director, Litigation Services, develops policies, procedures and operating goals related to the Trustee Services functions and the Unclaimed Trust Funds programs. 
    • Oversees the implementation of procedural and quality standards, in accordance with Law Society objectives and Convocation requirements.  


    Client / Customer Service Delivery

    • The Manager is accountable for decisions regarding the wind up of law practices and the disposition (acceptance, decline) of applications under the Unclaimed Trust Funds program. 
    • Overseeing the orderly wind up of law practices and intervention in practices where a Licensee dies, disappears, is facing discipline or has been suspended, disbarred, etc. and where inadequate or no provisions have been made to protect client interests.  
    • Management of financial reporting related to wound-up practice funds and unclaimed fund transfers. 
    • Participation in, and oversight of, preparation of court documents related to trusteeship and passing of accounts, and representation of the Law Society at court as required. 
    • Participation in, and oversight of, activities related to claimant location and notification (searches, correspondence), particularly with respect to departmental publications in the Ontario Gazette and Web pages.
    • Participation in, and oversight of, activities related to database development, population, tracking and reporting related to Trustee Services functions and Unclaimed Trust Funds. 
    • Management of the activities of the Unclaimed Trust Funds Officer in disposition of Licensee and claimant applications to submit/claim unclaimed funds to the program, including review of background materials (accounting records, case files, efforts to notify claimants), assessment of reasonableness, and documentation / communication of decisions.
    • Carry a caseload or have oversight on complex high profile matters.

    • Hires, trains, develops and evaluates resources for Counsel, Forensic Auditor, Officers and other staff in accordance with the policies of the organization and best human resources practices.

    Performance Goals, Targets and Standards

    • Works with team members and the Director, Litigation Services to establish, monitor, refine and continuously improve processes, team and individual performance targets. 
    • Plays a lead role in promoting the program within the membership, including development of communications vehicles and strategies, working with licensees whose practices are in crisis, delivery of presentations at meetings and conferences, and ongoing interaction with Licensees, claimants and the public regarding the goals and mandate of the program. 


    Financial Responsibility


    • Makes decisions regarding the disposition of applications under the Unclaimed Trust Funds program, including approval of disbursement of funds to claimants, and contribution to the management of unclaimed funds in the best interest of the public and the profession. 
    • Contributes to the development of the annual departmental budget and approves all invoices and expenditures related to departmental operations.


    Team Membership


    • Works closely with the Director, Litigation Services and other senior staff in the Professional Regulation Division other Staff Trustee and Unclaimed Trust Fund staff, and representatives of the Finance department to ensure prompt and seamless service delivery. 
    • Works in collaboration with other regulatory areas and the Finance department regarding the unclaimed trust funds.  
    • Provides analysis and support to the Director, Litigation Services, Committees, Senior Counsel and others within and outside the Trustee / Unclaimed Trust Fund department.


    Policy Development


    • In conjunction with the Director and other senior staff, identifies issues requiring policy change or development. 
    • Undertakes strategic analysis with respect to trends and developments in Trustee and Unclaimed Trust Fund activities, identifies priorities for policy review and work process improvement initiatives, and participates in the development of policy as assigned.
